On Thursday, November 10, 2022, the Supreme Court of the State of Florida ruled on the Uncontested Report of the Referee Accepting Consent Judgment concerning Miami Attorney Grant Griggith Sarbinoff for misconduct.

The case, titled The Florida Bar v. Grant Griggith Sarbinoff was brought by the Florida Bar. Case number #SC22-573.

The charges cited Rules Regulating the Florida Bar 4-8.4(b) which states:

A lawyer shall not commit a criminal act that reflects adversely on the lawyer’s honesty, trustworthiness, or fitness as a lawyer in other respects.

The following are as alleged and summarized from the filing:

Mr. Sarbinoff allegedly engaged in the misconduct of having entered a plea and having been adjudicated guilty on two counts of Criminal Use of Personal Identification Information, one count of Unlawful Use of a Two-Way Communication Device, and sixteen Offenses Against Users of Computers on November 24, 2021. Adjudication was withheld as to all of the aforementioned charges, other than one count of Criminal Use of Personal Identification Information. Mr. Sarbinoff was sentenced to 90 days in jail and probation.

These felonies were in connection to Sarbinoff’s alleged stalking and cyberstalking of his ex-girlfriend.

The Report of Referee Accepting Consent Judgment recommended that Mr. Sarbinoff be found guilty of misconduct and that he be suspended from the practice of law for a period of three years nunc pro tunc to May 30, 2022. It also recommended Respondent pay the Florida Bar’s costs.

With the foregoing facts and discussions, the court ruled against the Respondent in relation to the above-cited Rules of Professional Conduct

The Disposition reads:

“The uncontested report of the referee is approved and respondent is suspended from the practice of law for three years. Respondent is currently suspended; therefore this suspension is effective nunc pro tunc, May 30, 2022.

Judgment is entered for The Florida Bar, 651 East Jefferson Street, Tallahassee, Florida 32399-2300, for recovery of costs from Grant Griffith Sarbinoff in the amount of $1,402.25, for which sum let execution issue.”
