On Tuesday, November 21, 2023, the Supreme Court of Louisiana disciplined Attorney W. Brett Cain for his involvement in a hit-and-run accident.
The case is titled ‘In Re: W. Brett Cain’ with case no. 2023-B-1201.
The cited violations involve Rules 8.4(a) and 8.4(b) of the Louisiana Rules of Professional Conduct relating to criminal acts that reflect adversely on a lawyer’s honesty, trustworthiness, or fitness.

According to the filing, Attorney Cain was involved in an automobile accident in which he struck another vehicle, resulting in serious injury to the other driver. Cain then left the scene of the accident. He was later arrested and charged with hit-and-run.
The Office of Disciplinary Counsel commenced an investigation into the matter. Attorney Cain and the ODC submitted a joint petition for consent discipline in which Cain admitted to his wrongdoing.
In its ruling, the Supreme Court accepted the petition for consent discipline and suspended Attorney Cain from practicing law for one year and one day, with all but 30 days deferred. Following his active suspension, Attorney Cain will be placed on probation for two years, subject to conditions outlined in the petition. He must also pay all costs and legal expenses associated with the proceeding.
The disposition reads:
“IT IS ORDERED that the Petition for Consent Discipline be accepted and that W. Brett Cain, Louisiana Bar Roll number25997, be suspended from the practice of law for a period of one year and one day, with all but thirty days deferred.”
According to Avvo, Attorney W. Brett Cain is a general practice attorney based in Lake Charles, Louisiana. He acquired his license to practice in the state in 1999.
