On Wednesday, March 19, 2025, the Massachusetts Supreme Judicial Court placed Attorney Donald C. Kupperstein on disability inactive status. This decision followed a petition for disability inactive status submitted by Bar Counsel.

The case is entitled “In the Matter of Donald C. Kupperstein,” with case no. BD-2025-024.

The court’s order noted that both parties had waived a hearing and agreed to the order’s entry. As a result, Kupperstein’s disability inactive status is effective immediately, pending any further directives from the court.

Following the Supreme Judicial Court Rule 4:01, § 13, (2), the court outlined several obligations for Kupperstein. He is required to notify all relevant parties within fourteen days of the order’s issuance. This includes filing a notice of withdrawal from any ongoing legal matters with the appropriate courts, agencies, or tribunals, along with details on each case, such as client residences and docket numbers.

Kupperstein must also resign from any fiduciary roles he holds, including positions as guardian, executor, or trustee. This resignation must be accompanied by notices sent to affected parties, including wards and beneficiaries, detailing the changes and emphasizing the urgency of finding new legal representation if necessary.

Furthermore, Kupperstein is tasked with notifying all clients, wards, heirs, and beneficiaries about his status change and disqualification from practicing law. He must also ensure that any papers or property belonging to clients are made available to them and refund any unearned fees.

The order stipulates that all notices should be sent via certified mail with return receipts. Kupperstein is required to file an affidavit with the Office of the Bar Counsel within twenty-one days, certifying his compliance with the order and bar disciplinary rules. This affidavit must include details such as the names and addresses of all notified parties and documentation of any funds held in trust or fiduciary accounts.

Additionally, Kupperstein must submit a copy of the compliance affidavit to the Clerk of the Supreme Judicial Court for Suffolk County, along with a list of jurisdictions where he is admitted to practice and an address for future communications.

The Disposition states:

“Accordingly, it is ORDERED that: Donald C. Kupperstein shall be placed on disability inactive status from the practice of law in the Commonwealth until further order of this Court pursuant to Supreme Judicial Court Rule 4:01, S 13, (2) effective immediately upon the entry of this Order.”
