On Monday, May 1, 2023, the Michigan Attorney Disciplinary Board suspended attorney Hanna M. Renna as a form of reciprocal discipline after her earlier suspension in the State of Florida. The case is entitled “Attorney Grievance Commission v. Hanna M. Renna,” with case no. 23-13-RD.
On January 4, 2023, in the matter entitled The Florida Bar v Hanna Mary Renna, Case No. SC22- 1484, the respondent was suspended for 90 days with terms and conditions. This is in relation to the matter wherein the respondent during the representation of a criminal defendant, conducted a deposition of a minor witness who had previously identified her client from a photo pack as the perpetrator. Prior to the deposition, the respondent allegedly printed copies of the photo pack and renumbered them. Without the knowledge of the State and the witness, the respondent used a photograph of a different person than who was identified by the witness when questioning the witness about identification. The respondent then relied in part on the identification made during the deposition to file a motion to suppress.
Due to this conduct, the Supreme Court of Florida suspended the respondent for 90 days with terms and conditions. Following this event, the Grievance Administrator filed a notice of the filing of reciprocal discipline against the respondent to discipline the same in the state of Michigan.
The Order of Suspension states:
“Under M CR 9. 120( C) (Under MCR 9.120(C)(I ), misconduct is established and comparable discipline shall be imposed in Michigan unless it is established that respondent was not afforded due process of law in the of the original proceeding, or that the imposition of comparable discipline in Michigan would be clearly inappropriate. In the notice, the Grievance Administrator indicated he had no objection to the imposition of comparable discipline, which in Michigan would be a 90-day suspension, and that he does not believe that the conditions ordered in the Florida order are necessary. “
In lieu of the said misconduct and the filing of reciprocal discipline, the Attorney Disciplinary Board decided to suspend the respondent from the practice of law.
The Disposition states:
“NOW THEREFORE, IT IS ORDERED that respondent’s license to practice law in Michigan is SUSPENDED FOR 90 DAYS, EFFECTIVE MAY 30, 2023, and until respondent’s filing of an affidavit of compliance with the Attorney Discipline Board and the Attorney Grievance Commission in accordance with MCR 9.123(A).”
