The disciplinary action stemmed from a stipulation for a consent order of discipline filed by White and the Grievance Administrator, as outlined under Michigan Court Rule 9.115(F)(5). The agreement was approved by the Attorney Grievance Commission and accepted by the hearing panel.
The stipulation included White’s admission to factual allegations and specific charges of professional misconduct detailed in a formal complaint, while two subparagraphs, 24(d) and 24(f), were dismissed. The misconduct occurred during White’s representation of a client in a criminal jury trial, where he failed to object to the introduction of inadmissible evidence used to impeach a witness. This failure was found to have prejudiced his client.
The hearing panel determined that White violated multiple Michigan Rules of Professional Conduct, including MRPC 1.1 for failing to provide competent representation, MRPC 1.2(a) for not pursuing his client’s lawful objectives, and MRPC 1.3 for lacking reasonable diligence and promptness in his representation. Additionally, the panel found that White’s actions violated MCR 9.104(2), as they brought disrepute to the legal profession or the court.
The Disposition states:
“In accordance with the stipulation of the parties, the panel ordered that the respondent be reprimanded. Costs were assessed in the amount of $750.00.”
According to Avvo.com, Mr. White Jr. is a criminal defense attorney in Ypsilanti, Michigan. He attended Wayne State University Law School, graduating in 1977. He acquired his law license in Michigan in the same year.
