On Tuesday, May 27, 2025, the Supreme Court of Missouri suspended the law license of attorney James Michael Roswold indefinitely, with no opportunity to apply for reinstatement for six months. The suspension was stayed, and Roswold was placed on a two-year probation period, effective immediately, under conditions outlined by a Disciplinary Hearing Panel.
The case is entitled “In the Matter of James Michael Roswold,” with case no. SC100824
Roswold, who founded Kansas City Accident Injury Attorneys in 2018, faced allegations stemming from complaints filed in 2019 by three former employees and two clients. A regional disciplinary committee initiated proceedings, accusing Roswold of multiple violations of the Rules of Professional Conduct. After an 11-day hearing, the panel determined that Roswold failed to provide competent and diligent representation to two clients, violating Rules 4-1.1 and 4-1.3. He was also found to have violated Rule 4-1.4 by not keeping a client adequately informed and failing to explain third-party liens sufficiently. Additionally, the panel ruled that Roswold violated Rules 4-5.3(c)(1) and 4-8.4(a) by permitting two paralegals to engage in the unauthorized practice of law. The panel further found that Roswold violated Rule 4-8.4(c) by recording client phone calls without their knowledge or consent.
The Disciplinary Hearing Panel recommended the indefinite suspension with a six-month bar on reinstatement, to be stayed in favor of two years of probation. Roswold contested the findings, arguing that the chief disciplinary counsel did not prove any rule violations and requesting no disciplinary action. The chief disciplinary counsel agreed with the panel’s findings, except for a charge related to Rule 4-8.4(d), clarifying that Roswold was not found to have intentionally made a false statement during the investigation.
The Supreme Court ordered Roswold to pay a $1,500 fee to the Advisory Committee Fund and cover court costs.
