On Wednesday, May 29, 2024, the Supreme Court of the State of New York Appellate Division: Second Judicial Department disbarred attorney Young Min Kim based on disciplinary actions taken against him by the Supreme Court of New Jersey.
The case is entitled “In the Matter of Young Min Kim,” with case no. 2022-09965.
Kim was originally admitted to practice law in New York in 2001 and in New Jersey in 2006. In 2016, Kim was temporarily suspended from practicing law in New Jersey for failing to cooperate with an investigation into his escrow account. Despite this suspension, Kim continued representing a New Jersey Eastern American Certified development company and submitting legal documents on its behalf.
Kim was later suspended for three years by New Jersey in 2020 for additional misconduct regarding failing to communicate with a client and cooperate with disciplinary authorities. However, he continued practicing law during this suspension as well. When the suspension was discovered by the U.S. Small Business Administration in 2020, Kim claimed ignorance of the suspension.
New Jersey authorities then brought further charges against Kim for knowingly practicing law while suspended and failing to cooperate with their investigation. Kim did not respond to the allegations, so they were deemed admitted. Given Kim’s repeated unauthorized practice and disregard for proper procedures, the Supreme Court of New Jersey disbarred him in November 2022.
Kim also failed to properly notify authorities in New York of any of his prior disciplinary issues in New Jersey. In response, the New York Appellate Division initiated reciprocal discipline proceedings against Kim in December 2022. As he did not deny the New Jersey findings, Kim was disbarred in New York as well and his name was stricken from the roll of attorneys allowed to practice in the state. He is now prohibited from practicing law in both New Jersey and New York.
The Disposition states:
“Accordingly, based on the findings of the Supreme Court of New Jersey, we find that the imposition of reciprocal discipline is warranted, and effective immediately, the respondent is disbarred, and his name is stricken from the roll of attorneys and counselors-at-law.”
According to the filing, Mr. Kim acquired his law license in New York in 2001.
