On Thursday, August 28, 2025, the New York Supreme Court, Appellate Division, Third Judicial Department granted the request of attorney Howard Jeffrey Schmidt to resign from the New York bar for nondisciplinary reasons. Schmidt submitted his application to resign, which was supported by the Attorney Grievance Committee for the Third Judicial Department.

The court’s decision followed a review of Schmidt’s affidavit, which was sworn on June 30, 2025, and subsequently filed on July 3, 2025. The Attorney Grievance Committee indicated that they did not oppose Schmidt’s resignation, paving the way for the court’s approval.
In its ruling, the court formally accepted Schmidt’s resignation, ordering that his name be removed from the roll of attorneys and counselors-at-law in New York State, effective immediately. This decision prohibits Schmidt from practicing law in any capacity within the state. He is barred from appearing as an attorney before any court or public authority and is commanded to refrain from offering legal opinions or advice.
Additionally, the court ordered Schmidt to return any Attorney Secure Pass issued to him to the Office of Court Administration within 30 days of the decision.

“It is ORDERED that Howard Jeffrey Schmidt’s application for permission to resign is granted and his nondisciplinary resignation is accepted; and it is further ORDERED that Howard Jeffrey Schmidt’s name is hereby stricken from the roll of attorneys and counselors-at-law of the State of New York, effective immediately.”
According to Avvo.com, Mr. Schmidt is an attorney in Sayreville, New Jersey. He attended Seton Hall University, graduating in 1971. He acquired his law license in New York in 1987.
