On Tuesday, January 2, 2025, the New York Supreme Court, Appellate Division, Third Judicial Department granted the resignation request of attorney Elizabeth Napier Martin. Martin submitted her application for resignation for non-disciplinary reasons. The Attorney Grievance Committee for the Third Judicial Department did not oppose her request.

The case is entitled “In the Matter of Elizabeth Napier Martin,” with case no. PM-03-25.

Martin sworn an affidavit on November 19, 2024, which was officially submitted to the court on November 25, 2024. The court considered her affidavit along with a response letter from the Deputy Chief Attorney of the Attorney Grievance Committee dated December 17, 2024. After reviewing the documents, the court determined that Martin met the eligibility criteria for resignation under the applicable rules.

The court’s decision included an order to strike Martin’s name from the roll of attorneys and counselors-at-law in the State of New York, effective immediately. Furthermore, the order prohibits Martin from practicing law in any capacity within the state. She is barred from appearing as an attorney or counselor-at-law before any judicial or public authority and is also restricted from offering legal opinions or advice.

In addition to these prohibitions, Martin has been instructed to return any Attorney Secure Pass issued to her to the Office of Court Administration within 30 days of the decision.

The Disposition states:

“ORDERED that Elizabeth Napier Martin’s application for permission to resign is granted and her nondisciplinary resignation is accepted.”

According to the filing, Ms. Martin acquired her law license in 1990.
