On Wednesday, June 18, 2025, the New York Supreme Court, Appellate Division, Third Judicial Department reinstated attorney Carrie Barbra Smith to the practice of law, following her suspension in October 2021.

The case is entitled “In the Matter of Carrie Barbra Smith,” with case no. PM-140-25.

Smith had been suspended by the court in 2021 for violating Judiciary Law § 468-a. On March 25, 2025, Smith, representing herself, swore a motion for reinstatement, supported by an affidavit and exhibits. The Attorney Grievance Committee for the Third Judicial Department responded to the motion on April 30, 2025.

The court evaluated Smith’s application based on several criteria. They found clear and convincing evidence that Smith met the requirements outlined in the Rules of the Appellate Division, Third Department (22 NYCRR § 806.16 [c] [5]). The court determined that she had complied with the suspension order and the court’s rules, demonstrated the necessary character and fitness to practice law, and that her reinstatement would serve the public interest.

The reinstatement marks the conclusion of a process that began with her formal request earlier in the year, allowing her to return to legal practice after a nearly four-year suspension.

The Disposition states:

“It is ORDERED that respondent’s motion for reinstatement is granted; and it is further ORDERED that respondent is reinstated as an attorney and counselor-at-law, effective immediately.”
