On Thursday, May 4, 2023, the State of New York Supreme Court, Appellate Division Third Judicial Department granted the reinstatement of attorney Michael John Naughton from the practice of law in the state.
The case is entitled “In the Matter of Michael John Naughton,” with case no. 101-23.
In a recent legal development, the respondent has submitted a motion to the court, seeking an order for reinstatement to the practice of law. This motion follows the respondent’s suspension as a result of a court order issued in September 2022. The suspension case, known as Matter of Attorneys in Violation of Judiciary Law § 468-a, 208 AD3d 1421, 1438 [3d Dept 2022], is referenced in the motion. According to the court, the respondent’s request aligns with the Rules for Attorney Disciplinary Matters and the Rules of Appellate Division, Third Department.
Upon careful review of the respondent’s notice of motion and affidavit, along with exhibits sworn to on January 17, 2023, and supplemental papers sworn to on February 24, 2023, the court has also considered the responsive correspondence it received from the Attorney Grievance Committee for the Third Judicial Department on February 23, 2023, in which after evaluating the evidence presented, the court has determined the following:
- The respondent has fully complied with the court’s order of suspension and adhered to the rules of the court.
- The respondent possesses the necessary character and fitness required for the practice of law.
- Reinstating the respondent to the practice of law would serve the public interest.
In light of these findings, the court has issued an order granting the respondent’s motion for reinstatement. This decision signifies a significant step toward the respondent’s return to the legal profession.
The Disposition states:
“ORDERED that respondent’s motion for reinstatement is granted; and it is further ORDERED that respondent is reinstated as an attorney and counselor-at-law, effective immediately.”
