On Thursday, October 23, 2025, the New York Supreme Court, Appellate Division, Third Judicial Department granted the Attorney Grievance Committee’s motion to strike the name of attorney Kevin Michael Litz from the roll of attorneys, effectively disbarring him. The decision stems from Litz’s felony conviction in Schenectady County Court.

Litz was initially arraigned on a multicount felony indictment in March 2025. The charges arose from an incident involving Litz’s notarization of a witness’ signature on a self-proving affidavit, which he subsequently attempted to file with the Surrogate’s Court.
On September 5, 2025, Litz pleaded guilty to one count of tampering with physical evidence, a class E felony under New York Penal Law § 215.40 [1] [b]. This plea was made in full satisfaction of the original indictment. Following the guilty plea, the Attorney Grievance Committee (AGC) initiated proceedings to disbar Litz. According to court documents, Litz did not oppose the AGC’s motion.
The Appellate Court’s decision confirms Litz’s disbarment, making it effective retroactively to September 5, 2025, the date of his guilty plea. The court cited Judiciary Law § 90 [4] [a], [b], [e] and previous similar cases, including Matter of Pastel, Matter of Sherwood, and Matter of Butcher, in its ruling, emphasizing that a felony conviction results in automatic disbarment.
The order mandates that Litz cease practicing law in New York State in any capacity, including as a principal, agent, clerk, or employee. He is also prohibited from appearing as an attorney before any court, judge, or public authority, and from providing legal advice or holding himself out as an attorney.
Litz is further required to comply with the Rules for Attorney Disciplinary Matters, including the submission of an affidavit of compliance, and to surrender his Attorney Secure Pass to the Office of Court Administration within 30 days of the decision.
