On Wednesday, March 8, 2023, the Supreme Court of Pennsylvania disbarred attorney Lori A. Rexroth. The case is entitled “Office of Disciplinary Counsel v. Lori A. Rexroth” with case no. 62 DB 2018.
In the joint petition to temporarily suspend the respondent, filed by the latter and the Office of the Disciplinary Counsel on April 25, 2018, it was stated that while representing a client in divorce settlement proceedings, the respondent and client agreed to hold the client’s funds. However, the respondent failed to transfer the client’s funds to the firm’s IOLTA account upon the completion of the merger. Thereby, commingling her own funds with the client’s fund which later on she converted the same for her own personal use. In lieu of the event, the ODC and respondent requested the court to enter an order temporarily suspending the latter.
The filing states:
“Respondent and ODC believe that it would be in the best interest of Respondent and the legal system for Respondent to be immediately suspended at this time pending the ultimate resolution of any disciplinary proceedings arising as a result of the aforementioned allegations.”
On February 10, 2023, the respondent tendered before the Disciplinary Board of the Supreme Court of Pennsylvania her unconditional resignation from the practice of law. The respondent stated that she decided to tender such resignation because she knew that she could not successfully defend herself against the charges of professional misconduct.
The filing states:
“LORI A. REXROTH, hereby tenders her unconditional resignation from the practice of law in the Commonwealth of Pennsylvania in conformity with Rule 215 of the Pennsylvania Rules of Disciplinary Enforcement (“Enforcement Rules”) and further states as follows….7.) She is submitting the resignation because she knows that she could not successfully defend herself against the charges of professional misconduct set forth in the attached Exhibit A. 8.) She is fully aware that the submission of this Resignation Statement is irrevocable and that she can only apply for reinstatement to the practice of law pursuant to the provisions of Enforcement Rule 218(b) and (c).”
Following the verified statement of the resignation of the respondent, the court in an order dated March 8, 2023, decided to disbar the respondent.
The Disposition states:
“And Now, this 8th day of March 2023, upon consideration of the Verified Statement of Resignation, Lori A. Rexroth is disbarred on consent from the Bar of this Commonwealth retroactive to July 25, 2018.”
