On Wednesday, May 10, 2023, the Supreme Court of Califonia suspended attorney Steven Clifford Bailey for multiple violations of the California Rules of Professional Conduct.
The case is entitled “In the Matter of Steven Clifford Bailey,” with case no. S278919.
In a notice of disciplinary charges dated September 6, 2022, the respondent was charged with violations of the judicial canon; by allowing his name to be used on the website without reviewing the final text of the testimonial or instructing the Redd Group to avoid using his judicial title, by failing to provide California Judges Association (CJA) with important facts relevant to the question of whether he was required to disclose that his son worked at CHI Monitoring LLC and that he, rather than the probation department, would be making the referrals, by ordering the defendant to pay restitution to CHI in violation of the law, based on a letter from this son who worked for CHI. The respondent had seven more violations as per the notice of charges. In lieu of this, the State Bar notified that the respondent may pay a monetary sanction if found guilty.
The Notice of Disciplinary Charges states:
“In the event, this matter results in actual suspension, disbarment, or resignation with charges pending, you may be subject to the payment of monetary sanction not to exceed $5,000 for each violation, to a maximum of $50,000 per disciplinary order, pursuant to Business and Professions Code Section 6086.13. See Rule 5.137.”
Following the charges, the respondent filed his response on September 28, 2022. In his answer, the respondent stated that the charges fail to set out the claims with sufficient particularity to permit the respondent to raise all appropriate defenses and thus he reserves the right to add additional defenses as the bases for the State Bar’s purported claims become known. The respondent prays that the court finds that he did not commit acts constituting professional misconduct and that the Notice of Disciplinary Charges be dismissed.
In lieu of the aforementioned facts, the court decided to suspend the respondent from the practice of law.
The Disposition states:
“The court orders that Steven Clifford Bailey (Respondent), State Bar Number 146382, is suspended from the practice of law in California for one year, execution of that period of suspension is stayed, and Respondent is placed on probation for two years.”
