On Tuesday, May 23, 2023, the Supreme Court of Missouri suspended attorney Benjamin Patrick Campbell. The case is entitled “In the matter of Benjamin Patrick Campbell” with case no. 69450.

The charges cited Missouri Rules of Professional Conduct Rules 4-1.3, 4-1.4, 4-1.15(a), 4-1.15(a)(7), 4-1.15(d), 4-1.15(f), and 4-3.2. 

With careful consideration and understanding of the matter at hand, the court, having reviewed the acceptance statement filed by the involved parties in the Disciplinary Hearing Panel decision, determined that the respondent violated several provisions of the Rules of Professional Conduct. Consequently, disciplinary action was deemed necessary.

After taking into account these findings, past judgments rendered by the court, the guidelines provided by the ABA Standards for Imposing Lawyer Discipline, as well as the presence of aggravating and mitigating factors, the court imposed the following penalty on the respondent: Indefinite suspension without the possibility of applying for reinstatement for a duration of two years.

However, the implementation of this suspension was temporarily halted, and the respondent was placed under probation for a period of five years, commencing from the date of the order, in accordance with Rule 5.225. The terms and conditions of the probation align with those outlined in the Disciplinary Hearing Panel decision.

Furthermore, the respondent is required to pay a fee of $1,000.00, as per Rule 5.19(k), to the clerk of the court, to be credited to the advisory committee fund. The amount shall be taxed to the respondent.

The Disposition states:

“Upon consideration of these findings, previous decisions of this Court, ABA Standards for Imposing Lawyer Discipline, and aggravating and mitigating circumstances, the Court orders that Respondent, Benjamin Patrick Campbell, is hereby suspended indefinitely with no leave to apply for reinstatement for two years.”
