On Monday, July 14, 2025, the Board of Professional Responsibility of the Tennessee Supreme Court publicly censured attorney Mitchell Ray Miller. The censure resulted from Miller’s failure to fulfill his professional duties in a probate case.

Miller was retained to manage the probate of an estate, for which the client paid a fee totaling $2,996.50. Despite meeting with the client, Miller did not file the necessary petition to probate the estate. Additionally, he did not respond to four communications from the client over a one-month period, leading the client to hire new legal counsel to proceed with the probate.

The Board found that Miller’s actions constituted violations of the Tennessee Rules of Professional Conduct, specifically Rule 1.3 concerning diligence and Rule 1.4 regarding communication with clients. As part of the public censure, Miller is required to make restitution to the client in the amount of $2,996.50 within 90 days.

A public censure serves as a formal reprimand and warning to the attorney, but does not impact Miller’s ability to continue practicing law.
