On Thursday, February 2, 2023, the State of New York, Supreme Court, Appellate Division, Third Judicial Department accepted attorney Stephen Charles Tupper’s application for permission to resign for non-disciplinary reasons.
The case is entitled “In the matter of Stephen Charles Tupper” with case no. PM-18-23.
On December 20, 2022, the petitioner filed a sworn affidavit for the purpose of seeking leave to resign from the New York bar for non-disciplinary reasons. The Attorney Grievance Committee (ACG) for the third judicial department stated that it has no opposition to the application of the petitioner.
Upon reading the sworn affidavit and with the advice as stated by the ACG wherein it was declared that Mr. Tupper is eligible to resign for non-disciplinary reasons, the court granted the application and accepted his resignation.
The Disposition states:
“ORDERED that Stephen Charles Tupper’s application for permission to resign is granted and his nondisciplinary resignation is accepted.”
The petitioner was mandated to desist and refrain from the practice of law in any form in the State of New York, whether as an agent, principal, employee, or clerk. He is forbidden to appear as an attorney or counselor at law before any judge, court, justice, board, commission, or public authority. The petitioner must also refrain from giving his opinion as to the law and application, or any advice in relation as well.
