On Wednesday, September 4, 2024, the Board of Immigration Appeals reinstated attorney Stephen John Coghlan’s ability to practice before immigration courts and the Department of Homeland Security.
The case is entitled “In the Matter of Stephen John Coghlan.”
The Board had previously suspended Coghlan from practice for 60 days starting March 22, 2021, due to a California disciplinary action. However, in their recent ruling, the BIA granted Coghlan’s motion for reinstatement based on the evidence provided.
The ruling noted that Coghlan had been allowed to resume the practice of law in California. Both the disciplinary counsels for the Executive Office for Immigration Review and DHS reviewed the case and did not object to Coghlan being reinstated. They also reported that Coghlan appeared to comply with all terms of the original suspension order.
With no parties opposing, the Board reinstated Coghlan’s privilege to represent clients before immigration courts, the Board, and DHS effective immediately. The order also stated that Coghlan must file a Notice of Appearance even in cases where he previously represented clients prior to the suspension.
