On Tuesday, November 22, 2022, the Attorney Discipline Board of the State of Michigan ruled on Berkley attorney L. David Bush’s motion to set aside the default and order of suspension against him for professional misconduct.

The case is styled ‘Grievance Administrator v. L. David Bush’ with case no. 21-1-GA.

The charges cited Michigan Rules of Professional Conduct MRPC 1.1(c), 1.3, 1.4(a) and (b), 1.16(d), 3.3(a)(1), 4.1, 5.5(a), 8.1(a)(2), and 8.4(a),(b) and (c).

The following are as alleged and summarized from the filing:

On June 22, 2022, Tri-County Hearing Panel #66 of the Attorney Discipline Board ordered the two-year suspension of Bush from the practice of law in Michigan, effective July 14, 2022, for engaging in misconduct during his representation of two separate client matters. Bush was alleged to have practiced law while under suspension and failed to answer requests for investigation. Bush filed a petition for review, arguing that the hearing panel abused its discretion in failing to grant his motion to set aside the default, and requesting a hearing on the merits of the hearing panel. The hearing panel subsequently issued its report, finding Bush committed the alleged misconduct, and concluded that Bush’s license to practice law in Michigan be suspended for two years.

On review, the Board agreed with the hearing panel’s findings and ruled against Bush in relation to the above-cited misconduct.

The Order reads:

“IT IS ORDERED that the hearing panel’s May 17, 2022 order denying respondent’s motion to set aside the default and order of suspension issued June 22, 2022, are AFFIRMED.

IT IS FURTHER ORDERED that respondent shall, on or before December 21, 2022, pay costs in the amount of $2,137.47, consisting of costs assessed by the hearing panel in the amount of $1,920.97 and court reporting costs incurred by the Attorney Discipline Board in the amount of $216.50 for the review proceedings conducted on October 19, 2022.”

Prior to suspension, Mr. Bush practiced in Berkley, Michigan. He has been admitted to practice in Michigan.
