On Thursday, February 1, 2024, the Supreme Court of Florida approved a conditional guilty plea agreement between The Florida Bar and attorney Joshua Theodore Mosley that resulted in his 10-day suspension from practicing law and three years probation for two incidents of driving under the influence (DUI) in 2022 and 2023.

According to filings from The Florida Bar, Mosley faced disciplinary action related to violating professional conduct rules through criminal acts of DUI. On August 22, 2022, Mosley was arrested for DUI and later pleaded no contest to reckless driving with adjudication withheld and was placed on probation for 364 days. He was again arrested for DUI on June 17, 2023, along with other charges, and later pleaded no contest to DUI with property damage and refusal to submit to a chemical test.
Through a conditional guilty plea, Mosley admitted to violating Rules Regulating the Florida Bar, including committing criminal acts reflecting adversely on his fitness as a lawyer. As part of the agreement, he will be suspended from practicing law for 10 days, be on probation for three years with conditions like continuing rehabilitation and paying monthly monitoring fees, and references to his status as an attorney will be eliminated. The Florida Bar petitioned the Supreme Court of Florida for approval of this plea agreement.
The Supreme Court of Florida approved the conditional guilty plea and consent judgment on February 1, 2024, imposing the suspension and three-year probationary period on Mosley as outlined in the agreement. The court also entered a judgment ordering Mosley to pay $1,250 in costs to The Florida Bar.
