On Thursday, November 7, 2024, the New York Supreme Court, Appellate Division, Third Judicial Department reinstated Kyong Jin Yo as an attorney. The court’s decision comes after a thorough review of Yo’s compliance with the terms of his suspension, which had been imposed in May 2019 due to violations of Judiciary Law § 468-a.

The case is entitled “In the Matter of Kyong Jin Yo,” with case no. PM-215-24.

The reinstatement order was issued after the court examined documents submitted by Yo, including an affidavit sworn on September 6, 2024, and additional filings dated October 8, 2024. The court found clear and convincing evidence that Yo had met the necessary criteria for reinstatement, which included adherence to the rules governing attorney conduct and demonstrating sufficient character and fitness to practice law.

The Attorney Grievance Committee for the Third Judicial Department acknowledged the findings and supported the reinstatement. The committee had previously raised concerns regarding Yo’s conduct that led to the suspension but found that the respondent had taken appropriate steps to address those issues.

In its ruling, the court emphasized that reinstating Yo was in the public interest, a key factor in their decision-making process.

The Disposition states:

“ORDERED that respondent is reinstated as an attorney and counselor-at-law, effective immediately.”
