On Thursday, August 21, 2025, the New York Supreme Court, Appellate Division, First Judicial Department granted the resignation of attorney Regina L. Darby, effectively disbarring her from practicing law in the state. Darby submitted her resignation amid an ongoing disciplinary investigation by the Attorney Grievance Committee (AGC) for the First Judicial Department.
The case is entitled “In the Matter of Regina L. Darby,” with case no. 2025-03487.
In her affidavit of resignation, Darby acknowledged that she was the subject of an investigation involving two allegations of professional misconduct. The first allegation related to a commercial case that was dismissed, partly due to her failure to appear in court. The second allegation involved her commencing an action but later advising her client that she could no longer represent them, without formally withdrawing from the case.
Darby clarified that the AGC’s investigation did not accuse her of willfully misappropriating client funds. In her affidavit, she expressed her belief that she could not successfully defend against the allegations based on the facts presented. She stated that her resignation was made voluntarily and without coercion, fully understanding the consequences, including the disbarment order that would result from her resignation.
The AGC indicated that it did not oppose Darby’s motion to resign during the pending investigation and supported her request for resignation.
The court found that her affidavit complied with the necessary legal standards and accepted her resignation. Consequently, her name was stricken from the roll of attorneys in New York, with the disbarment taking effect retroactively from May 30, 2025, the date of her affidavit.
The court’s order further prohibited Darby from engaging in any form of legal practice, whether as a principal or as an employee of another, and forbade her from appearing as an attorney before any court or authority. Additionally, she is required to comply with the rules governing disbarred attorneys.
According to Avvo.com, Ms. Darby was an employment and labor attorney in Yonkers, New York. She acquired her law license in New York in 1977.
