On Thursday, June 1, 2023, the State of New York Supreme Court, Appellate Division Third Judicial Department granted the motion for reinstatement of attorney Jung Sun Lee.

The case is entitled “Attorney Grievance Committee for the Third Judicial Judicial Department v. Jung Sun Lee” with case no. PM-115-23.

In a recent legal development, the petitioner has submitted a motion seeking an order for her reinstatement to the practice of law. This motion comes after her suspension by the October 2021 order of the Court, as detailed in Matter of Attorneys in Violation of Judiciary Law § 468-a, 198 AD3d 1068, 1080 [3d Dept 2021]. Pertinent to this matter are the Rules for Attorney Disciplinary Matters and the Rules of App Div, 3d Department.

After a comprehensive review of the respondent’s notice of motion, accompanied by an affidavit sworn on January 31, 2023, along with exhibits and the March 16, 2023 correspondence from the Attorney Grievance Committee for the Third Judicial Department, the court, relying on clear and convincing evidence, has made several crucial determinations. Firstly, it has been established that the respondent has fully complied with the order of suspension and has diligently followed the rules set by the court. Secondly, the court has found that the respondent possesses the necessary character and fitness required for the practice of law. Lastly, taking into consideration the public interest, the court has determined that it is in the best interest to reinstate the respondent to the practice of law. This decision draws upon legal precedents such as Matter of Attorneys in Violation of Judiciary Law § 468-a [Lefkowitz], 213 AD3d 1072, 1074-1075 [3d Dept 2023].

Consequently, the court has issued an order granting the respondent’s motion for reinstatement, effectively permitting her to resume the practice of law. This decision reflects the court’s careful consideration of the respondent’s compliance, character, and overarching public interest in the administration of justice.

The Disposition states:

“ORDERED that respondent’s motion for reinstatement is granted; and it is further ORDERED that respondent is reinstated as an attorney and counselor-at-law, effective immediately.”
