On Thursday, November 17, 2022, the Supreme Court of Florida granted the petition for Disciplinary Revocation filed by Salt lake Attorney Brandon James Vitola over his case of alleged misconduct. The case is entitled “In the matter of Brandon James Vitola” and was brought by The Florida Bar. Case #SC22-1109.

On August 8, 2022, the Respondent filed a Petition for Disciplinary Revocation. The Disciplinary charges alleged that Petitioner sold a law reference that was the property of his employer that was provided for petitioner’s use while employed. The respondent contended that granting the petition will not affect the public interest, the integrity of the courts, or the confidence of the public in the legal profession. 

On October 10, 2022, a response to the petition for revocation was filed by the Florida Bar. The Bar supported the petition and filed a motion to assess costs. Hence, this order from the Supreme Court of Florida was issued. 

The Order states:

‘The uncontested petition for disciplinary revocation, as provided by Rule 3-7.12, Rules Regulating the Florida Bar, with leave to seek readmission after five years, is granted subject to the continuing jurisdiction of this Court. See Floida Bar v. Ross, 732 So. 2d 1037, 1040-42 (Fla. 1998). Disciplinary revocation is tantamount to disbarment. Florida Bar v. Hale, 762 So. 2d 515 (Fla. 2000). Petitioner has advised that he is no longer practicing law; therefore the disciplinary revocation shall be effective immediately. The petitioner shall fully comply with Rule Regulating the Florida Bar 3-5. 1 (h). The petitioner shall also fully comply with Rule Regulating the Florida Bar 3-6.1, if applicable. 

Not final until time expires to file a motion for rehearing, and if filed, determined. The filing of a motion for rehearing shall not alter the effective date of this revocation. As with disbarment, in seeking readmission to The Florida Bar, the petitioner “may be admitted again only upon full compliance with the rules and regulations governing admission to the bar.’
