On Wednesday, June 25, 2025, the Michigan Attorney Discipline Board issued a notice announcing that attorney Jon H. Berkey’s law license has been suspended for 90 days. Berkey agreed to the disciplinary action through a stipulation approved by the Attorney Grievance Commission and accepted by Tri-County Hearing Panel #14.
The case is entitled “In the Matter of Jon H. Berkey,” with case no. 23-65-GA.
The suspension stems from multiple violations of the Michigan Rules of Professional Conduct (MRPC). Berkey admitted to misusing his Interest on Lawyers Trust Account (IOLTA) by holding excessive personal funds, violating MRPC 1.15(f). He also practiced law in California without authorization, breaching MRPC 5.5(a), and provided misleading advertisements about his ability to practice in the state, violating MRPC 7.1.
Additionally, Berkey used letterhead implying a partnership that did not exist, contravening MRPC 7.5(d), and failed to provide accurate contact information to the State Bar of Michigan. He also admitted to giving false statements to the Grievance Administrator, violating MRPC 8.1(a)(2) and 8.4(a), as well as MCR 9.104(4).
The hearing panel ordered the suspension and imposed conditions addressing the misconduct. Berkey was also assessed $1,985.13 in costs.
According to Avvo.com, Mr. Berkey is a real estate attorney in San Diego, California. He attended the Michigan State University College of Law. He acquired his law license in Michigan in 1968.
