On Thursday, September 1, 2022, the Indiana Supreme Court ruled on the submitted “Statement of Circumstances and Conditional Agreement for Discipline” stipulated by and between the Indiana Supreme Court Disciplinary Commission and Respondent Indianapolis attorney Justin A. Paicely relating to charges for attorney discipline against the latter for his commission of a criminal act.
The case titled ‘In the Matter of Justin A. Paicely’, was brought by the Indiana Supreme Court Disciplinary Commission, Case # 22S-DI-215.
According to the filing:
” In April 2022, Respondent pled guilty to operating a vehicle while intoxicated (OWI) with a prior conviction, a level 6 felony. Respondent has a prior misdemeanor OWI conviction, entered in 2015. Respondent has engaged the assistance of the Indiana Judges and Lawyers Assistance Program (JLAP) and has been under a voluntary monitoring agreement since January 2022.”
The filing continues:
“The parties agree that Respondent violated Indiana Professional Conduct Rule 8.4(b), which prohibits committing a criminal act that reflects adversely on Respondent’s trustworthiness or fitness as a lawyer. “
The Supreme Court of Indiana, in its Published Order Approving Statement of Circumstances and Conditional Agreement for Discipline, after consideration of the submissions of the parties, approved the proposed discipline of 90 days suspension from the practice of law, beginning on the date of the Order, with 30 days actively served and the remainder stayed subject to completion of at least one year of probation with JLAP monitoring.
Additionally, the Court denies as moot the Commission’s “Notice of Finding Guilt and Request for [Interim] Suspension” filed in this case.
Further, the court ordered Respondent to pay the costs of the proceedings in the amount of $264.86.
According to LinkedIn, Mr. Paicely is the Deputy General Counsel of the Indiana Department of Natural Resources. He attended Indiana University Robert H. McKinney School of Law. He practices in Indianapolis, Indiana and he has been licensed in Indiana.
