On Monday, December 12, 2022, attorney Matthew Lowy filed an Answer and Unconditional Admission before the Commission on Practice of the Supreme Court of the State of Montana. This is in response to a complaint against him involving his failure to respond and cooperate with the investigation regarding allegations against him.
The case is entitled “In the matter of Matthew Lowy” and was brought by the Office of the Disciplinary Counsel for the State of Montana with case no. 22-194.
The charges cited Montana Rules of Professional Conduct 8.1(b).
On November 30, 2022, in a Complaint filed by the Office of the Disciplinary Counsel, it was stated that the respondent was already disciplined on May 2021 in violation of the Rules of Professional Conduct of Montana. As part of the said discipline, the respondent was placed on probation and assigned an ODC Mentor. They were tasked to provide reports concerning the practice matters that involves the respondent himself. However, in the course of the mentorship, the respondent’s mentor has expressed concern in regard to the respondent’s ability to manage his law practice.
In Count one of the said Complaint, the respondent failed to respond to ODC’s request for a response involving allegations from one judge of the Second Judicial District about his representation of a client in a family law matter.
The filing states:
“On the morning of July 12, 2022, Respondent again emailed ODC explaining that he had not filed his response as he had fallen asleep at his desk and would send the response “imminently”. Respondent failed to respond, or provide any further communication.”
The filing continues:
“On July 22, 2022, Respondent emailed again, stating he was still sick and would provide a “substantive response” by the following Monday. On or after Monday, July 25, 2022, Respondent did not provide a response, nor did he provide any other justification for his failure to respond.”
In his Answer and Unconditional Admission, dated December 22, 2022, the respondent admitted unconditionally that he violated the abovementioned rule and stated that a formal hearing on the said allegations is unnecessary for he admits such charges.
