On Thursday, March 23, 2023, the State of New York, Supreme Court, Appellate Division, Third Judicial Department accepted Attorney Yuki Yamada’s petition for reinstatement.
The case is entitled “In the Matter of Yuki Yamada,” with case no. PM-60-23.
In September 2022 an order from the court was issued suspending attorney Yamada’s license to practice law. Following the suspension, attorney Yamada filed a motion for an order reinstating him.
In relation to the petition, Attorney Yamada filed a respondent’s notice of motion and affidavit with exhibits sworn on November 6, 2022, before the Supreme Court of New York. On the other hand, on December 27, 2022, the Attorney Grievance Committee filed a correspondence determining by clear and convincing evidence that the respondent has complied with the order of suspension and the rules of the court. Second, the respondent has the requisite character and fitness to practice law, and lastly, it would be in the public interest to reinstate the respondent to the practice of law.
Having considered the sworn affidavit filed by the respondent and the correspondence from the AGC agreeing with the petition, the court decided to grant the petition and reinstated attorney Yamada.
The order states:
“ORDERED that respondent’s motion for reinstatement is granted; and it is further ORDERED that respondent is reinstated as an attorney and counselor-at-law, effective immediately.”
